Terms of Use - DaDesktop Public Cloud

Purpose

The remote desktops provided are intended solely for the delivery of courses, consultancy services, or recruitment activities.

Non-permitted use

These specific uses are not allowed:

1. Hosting websites or any other services
2. Bitcoin mining
3. Running performance tests

Should our team identify any such prohibited activity, we will terminate the service immediately, and you will not be eligible for a refund.

 

Guarantee and Service Layer Agreement

DaDesktop promises 95% uptime for the service.

Maintenance, repairs, and upgrades will be carried out outside the hosted working window (8 am to 8 pm local time in Poland, as determined by the physical location of the server).

 

Data Safety and Confidentiality

The service is provided on an as-is basis, and DaDesktop does not guarantee that data copied to the desktops will remain confidential or secure. If you need such assurances, please explore DaDesktop On-Premise as an alternative.

Because the desktops are primarily used for training, they are not appropriate for handling highly confidential information.

Authentication for Remote Desktops is built with ease of use in mind, rather than as a robust security measure.

Troubleshooting Recording

To aid in troubleshooting, we may record Course Desktops (including Fresh-start, Trainer, and Participant desktops).

Disclaimers of Liability - Indemnification

DaDesktop offers the services on an as-is basis, with all faults and as available. Neither we nor our suppliers provide any express or implied warranties or guarantees regarding these services. To the fullest extent allowed by law, we disclaim any implied warranties of merchantability, satisfactory quality, accuracy, fitness for a particular purpose, or non-infringing. We do not promise that results from using the services will be effective, reliable, accurate, or suit your specific needs. We cannot guarantee that you will be able to access or use the services (either directly or through third-party networks) at any particular time or location. No oral or written statements from a DaDesktop representative will establish any warranty. You may retain other consumer rights under your local laws that this contract cannot override. You use the services at your own risk.

The only remedy available to you in any dispute with us or our suppliers is to cancel your account. Under no circumstances will the combined, total liability of us, our affiliates, and our suppliers for all claims connected to the use of the services go beyond the total fees you paid (if any) during the time those claims emerged. We, along with our affiliates and suppliers, will not be responsible for any indirect, special, incidental, consequential, or exemplary damages that result from your use or inability to use the services.
